Federal Transit Administration/Office of Civil Rights – Development of New Title VI Environmental Justice Review Guidelines

has an engagement with the Federal Transit Administration (FTA) Office of Civil Rights to develop and pilot test procedures, manuals, and checklists for use in conducting Title VI/Environmental Justice (EJ) assessments of FTA grantees. The new guidance will improve coordination and management of the civil rights compliance review process.

Title VI of the Civil Rights Act of 1964 prohibits discrimination in the provision of government services based on race, color, religion, and national origin. Furthermore, Executive Order 12898, "Federal Actions to Address Environmental Justice in Minority Populations and Low-Income Populations," February 1994, requires federal agencies to identify and address disproportionately high adverse human health or environmental effects of their policies and programs on minority and low-income populations.

began by interviewing Office of Civil Rights staff, and researching Title VI/EJ regulations and current practices in specific areas that have been the subject of complaints or lawsuits. developed written guidance for conducting in-depth Title VI/EJ assessments in four categories:

  • Multilingual Communications
  • Fare Increases
  • Service Changes
  • Equitable Allocation of Resources for Capital Projects.
To evaluate the new procedures, is conducting pilot reviews in each of the compliance areas at selected transit agencies throughout the nation. The review team takes special note of the agencies' public participation process and response to concerns expressed by protected groups.
